# Terms of service

These are the terms on which Analytiics provides its service. They are written
in plain language on purpose. If something here is unclear, write to
[hello@analytiics.co](mailto:hello@analytiics.co) and we will answer, and probably
fix the wording.

## The service

Analytiics is web and product analytics: a browser tracker, an event collector
at `in.analytiics.co`, a manifest and code generator, a command-line tool,
and dashboards at `www.analytiics.co`. Using any of them means you accept
these terms. The open-source packages — the tracker, the SDK, the manifest
tools and the CLI — are licensed separately under the licence in each
package, and nothing here narrows that licence.

## Your account

An account is an email address. You are responsible for what is done with
yours, and for keeping the write keys issued to your projects secret; a leaked
key can be revoked from the project's settings at any time. You must be at
least 18, or the age of majority where you live, to open one.

## Plans, billing and caps

Each plan covers a number of billable events a month and a number of
projects, as set out on the [pricing page](/pricing). A billable event is a
page view or an event you declare; the tracker's own bookkeeping is free. The
month is the calendar month in UTC.

Paid plans are billed monthly in advance through Stripe, who hold your card
details — we never see them. You can change or cancel a plan at any time from
your account page; a cancellation takes effect at the end of the period
already paid for, and we do not refund partial months unless the service was
unavailable to you for a substantial part of one. Prices may change; we will
give at least thirty days' notice by email before a change affects a plan you
are paying for.

Caps are soft. Past a plan's event cap the collector keeps one browser event in
ten until the month resets or the plan grows; nothing is switched off, nothing
is deleted, and server-side events are always kept in full. We will tell you
by email when an account passes 80% and 100% of its cap.

## What you may not do

- Send personal data in event properties — no names, emails, addresses,
  identifiers issued by governments, or text written by your users. The
  [privacy page](/privacy) explains why the product cannot filter this for
  you and so must ask you not to.
- Use the service to track people who have opted out of tracking where the
  law gives them that right, or on sites where you have no right to measure
  visitors.
- Post events into a project you do not own, probe the collector or the API
  for weaknesses, or attempt to read data that is not published to you.
- Resell the service, or run it in a way that is designed to defeat the plan
  caps.

We may suspend an account that does any of these, after telling you why,
unless the harm is ongoing and telling you first would make it worse.

## Your data

Event data belongs to you. We process it to provide the service, and for
nothing else: it is not sold, not used to build profiles across customers,
and not used to train anything. You may export it, and you may delete a
project at any time; what deletion does and does not remove is described in
the project's settings. Where you operate a site on which the tracker runs,
you are the controller of your visitors' data and we are your processor; ask
us for a data processing agreement if you need one signed.

Public dashboards are public. Anything a project publishes can be read by
anyone with the link and will carry a link back to us.

## What we promise, and what we do not

We will run the service with reasonable care, tell you about incidents that
affect your data, and give at least thirty days' notice before discontinuing
it. The service is otherwise provided as is: we do not promise it will be
uninterrupted or error-free, and analytics is by nature an approximation of
what happened rather than a record of it. Do not use it as the sole basis for
a decision that would be harmful if the numbers were wrong.

To the extent the law allows, our liability to you for anything arising from
the service is limited to the amount you paid us in the twelve months before
the claim, and neither of us is liable to the other for indirect or
consequential loss. Nothing here limits liability that cannot be limited by
law.

## Ending things

You can close your account at any time by deleting your projects and writing
to us; we will remove the account and the addresses it held. We can end the
agreement with thirty days' notice, or immediately for a breach of the section
above, and will give you a way to export your data first where we reasonably
can.

## Changes and law

We may update these terms. Material changes are announced by email at least
thirty days before they take effect; continuing to use the service after that
is acceptance. These terms are governed by the law of the jurisdiction in
which Analytiics is established, and disputes go to its courts, unless the
law where you live gives you a right that cannot be taken away — in which
case you keep it.
